Terms of Service

Effective date: March 16, 2026

1. Service Provider

These Terms of Service (“Terms”) govern the provision of electronic services through the website straktur.com (“Website”) by:

Hereinafter referred to as the “Provider.”

3. Electronic Services

The Provider offers the following services through the Website:

  1. Straktur Core (one-time payment) — access to the full Straktur source code, all future updates, documentation and implementation guides, production-ready architecture for internal tools, unlimited use across internal projects within the Customer’s organisation, with no per-seat fees.
  2. Straktur Guided (one-time payment) — everything included in Straktur Core, plus one live 2-hour onboarding session, an architecture walkthrough tailored to the Customer’s use case, guidance on the first implementation scope, and 7 calendar days of asynchronous follow-up by email.

4. Technical Requirements

To use the Website and the Products, the Customer needs a device with internet access and a modern web browser (e.g. Chrome, Firefox, Safari, Edge) with JavaScript enabled, as well as a valid email address.

5. Conclusion of Contract

  1. The information presented on the Website constitutes an invitation to enter into a contract, not a binding offer.
  2. The Customer places an order by selecting a Product and completing payment through the external payment processor (Stripe).
  3. The contract is concluded at the moment the Provider confirms receipt of payment and delivers access to the Product to the Customer’s email address.
  4. All prices are listed in US dollars (USD) and include all applicable taxes unless stated otherwise.

6. Delivery

Upon successful payment, the Customer receives access to the Product electronically (e.g. via a download link or repository access sent to the email address provided during checkout). Delivery occurs without undue delay, typically within minutes of payment confirmation.

7. Licence

  1. Upon payment, the Provider grants the Customer a non-exclusive, perpetual, non-transferable licence to use the Product for the Customer’s own internal business purposes.
  2. The Customer may use the Product across an unlimited number of internal projects within their own organisation.
  3. The Customer may not redistribute, resell, sublicence, or publicly share the Product’s source code, in whole or in part.

8. Right of Withdrawal — Important Notice

  1. In accordance with Article 38 point 13 of the Polish Consumer Rights Act of 30 May 2014 (Dz.U. 2014 poz. 827, as amended), the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium, if performance has begun with the Consumer’s prior express consent and acknowledgment that the right of withdrawal is thereby lost.
  2. The Product (Straktur source code) is digital content delivered immediately upon purchase. By completing the purchase the Consumer expressly: (a) consents to immediate delivery of the digital content before the expiry of the 14-day withdrawal period, and (b) acknowledges that this results in the loss of the right of withdrawal.
  3. The above consent is collected during the checkout process. The Provider confirms receipt of this consent on a durable medium (e-mail) in accordance with Articles 15 and 21 of the Consumer Rights Act. No refunds are available once the digital content has been delivered.
  4. For the Guided Services component only (consulting/onboarding included in the Straktur Guided package): if the onboarding session has not yet taken place, the Consumer may withdraw from that portion of the contract within 14 days by sending a clear statement to [email protected]. In such case, the Provider shall refund the difference between the Straktur Guided price and the Straktur Core price. Once the onboarding session has been scheduled or commenced, this right is lost.

9. Complaints

  1. The Customer may submit complaints regarding the services provided by the Provider by email to [email protected].
  2. A complaint should include the Customer’s identification data, a description of the issue, and the desired resolution.
  3. The Provider shall respond to the complaint within 14 days of receipt.

10. Liability

  1. The Product is provided “as is.” The Provider does not warrant that the Product will meet all of the Customer’s specific requirements or that it will operate without interruption in every environment.
  2. The Provider’s total liability under this contract shall not exceed the amount paid by the Customer for the Product.
  3. The above limitations do not apply to Consumers to the extent prohibited by mandatory provisions of Polish law.

11. Prohibited Content

In accordance with the Polish Act on Provision of Electronic Services of 18 July 2002, the Customer shall not provide content that is unlawful (treści o charakterze bezprawnym).

12. Personal Data

The Provider processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Polish data protection law. Details are set out in the Privacy Policy. Personal data provided during checkout is processed solely for the purpose of contract performance and, where applicable, for compliance with legal obligations.

13. Dispute Resolution

  1. Any disputes shall first be resolved amicably.
  2. The Consumer may seek out-of-court dispute resolution through a competent entity listed in the register maintained by the President of the Office of Competition and Consumer Protection (UOKiK), available at uokik.gov.pl.
  3. The Consumer may also seek assistance from a competent provincial inspector of the Trade Inspection (Wojewódzki Inspektor Inspekcji Handlowej) or a permanent consumer arbitration court operating at the provincial Trade Inspection office.
  4. Information on consumer rights and available ADR procedures within the EU is available at konsument.gov.pl.
  5. Disputes that cannot be resolved amicably shall be submitted to the court of competent jurisdiction under Polish law.

14. Amendments

The Provider reserves the right to amend these Terms. Changes take effect 14 days after publication on the Website. Contracts concluded before the amendment are governed by the Terms in force at the time of purchase.

15. Governing Law

These Terms are governed by the laws of the Republic of Poland. Mandatory consumer protection provisions of the Customer’s country of residence apply where required by law.
